Privacy Policy

This Privacy Policy describes how Axial Fans USA Inc. (“AFI USA,” “we,” “our,” or “us”) collects, uses, discloses and protects personal information about visitors and users of axialfansusa.com (the “Site”). It also explains the rights you may have with respect to your personal information under applicable United States privacy laws.
By using the Site, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with any part of it, please do not use the Site.
Who We Are and Scope of This Policy
Axial Fans USA Inc. is a corporation organized under the laws of the State of Delaware, operating from Kemah, Texas. AFI USA is a wholly-owned subsidiary of Axial Fans International S.r.l., an Italian company with its registered office in Italy (“AFI Italy” or “the parent company”).
This Privacy Policy applies solely to information collected through the Site. It does not apply to information collected through offline channels (such as trade shows, in-person meetings, or telephone calls), or to any third-party website that may be linked from the Site.
AFI USA serves industrial and commercial customers across North and South America. The Site is not intended for use by residents of the European Union, the United Kingdom, or other jurisdictions whose data protection laws would impose additional obligations, and AFI USA does not accept commercial inquiries from those regions through the Site.
Information We Collect
We collect two categories of information: information you voluntarily provide, and information automatically collected when you use the Site.
2.1 Information you provide
When you submit a contact form on the Site, we collect: your full name, company name, business email address, phone number (if you choose to provide it), the subject of your inquiry, and the content of your message.
If you download technical documents, brochures, datasheets or other resources from the Site, we may associate that download activity with your session for analytics and product-interest purposes.
2.2 Information collected automatically
When you visit the Site, we and our service providers may automatically collect certain technical information, including: your Internet Protocol (IP) address, browser type and version, operating system, device type, referring website, pages visited, time and date of your visit, and interaction data such as clicks and scroll depth. This information is collected through cookies and similar technologies, subject to your consent as described in Section 7 and in our Cookie Policy.
2.3 Information we do not collect
We do not knowingly collect Social Security numbers, financial account numbers, government-issued identification numbers, precise geolocation data, biometric data, health information, or information about your race, ethnicity, religion, sexual orientation, immigration status, or union membership through the Site.
How We Use Your Information
We use the information described above for the following purposes:
- To respond to your inquiries and provide the information, quotes, technical documentation or services you request;
- To maintain a record of your inquiry for reference in future communications and for legitimate business documentation;
- To operate, maintain, secure, and improve the Site and our products and services;
- To measure aggregate Site traffic and understand which content resonates with our audience (only when Analytics cookies are accepted);
- To detect, prevent and respond to fraud, security incidents, misuse of the Site, and violations of our Terms of Service;
- To comply with applicable law, respond to lawful requests from public authorities, and enforce our legal rights.
We do not use your personal information for automated decision-making that produces legal or similarly significant effects. We do not use your personal information for advertising targeted at specific individuals, and we do not engage in “profiling” as that term is defined under applicable US state privacy laws.
How We Share Your Information
We do not sell your personal information for money, and we do not share your personal information for cross-context behavioral advertising. We disclose your personal information only in the limited circumstances described below.
4.1 Corporate affiliates
Because AFI USA is a wholly-owned subsidiary of AFI Italy, information you provide through the Site may be accessed by authorized personnel of AFI Italy for internal administrative, engineering, technical support and quality assurance purposes. Any such access is subject to the same protections described in this Privacy Policy and to applicable data protection safeguards.
4.2 Service providers
We share information with vendors that perform services on our behalf and are contractually obligated to protect it. Current service providers include:
- Resend, Inc. for transactional email delivery (used to route contact form submissions to our team);
- Google LLC for website analytics (Google Analytics 4) and embedded maps, when Analytics or Functional cookies are accepted;
- Cloudflare, Inc. for hosting, content delivery, security and DDoS protection.
4.3 Legal disclosures
We may disclose personal information when we believe in good faith that disclosure is required by law, subpoena, court order or other legal process, or is necessary to protect the rights, property or safety of AFI USA, our employees, our customers, or the public.
4.4 Business transfers
If AFI USA is involved in a merger, acquisition, financing or sale of assets, personal information may be transferred to the acquiring entity, subject to protections consistent with this Privacy Policy.
Data Retention
We retain personal information only as long as necessary for the purposes described in this Policy, or as required by applicable law. Specifically:
- Contact form submissions are retained for up to twenty-four (24) months from the date of receipt, after which they are reviewed and either archived for legitimate business record purposes or deleted.
- Analytics data collected through Google Analytics 4 is retained for the default period configured in that platform (currently 14 months) after which it is automatically deleted.
- Server access logs are retained for up to ninety (90) days for security and troubleshooting purposes.
We may retain information for longer periods when required to comply with legal obligations, resolve disputes, or enforce agreements.
Data Security
We implement administrative, technical and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration and destruction. These measures include encrypted transmission (HTTPS/TLS), restricted access to systems that store personal information, logging and monitoring, and periodic review of our security posture.
No method of transmission over the Internet or method of electronic storage is one hundred percent secure. While we strive to protect your personal information, we cannot guarantee absolute security. If we become aware of a security breach affecting your personal information, we will notify you and applicable authorities in accordance with applicable law.
Cookies and Similar Technologies
We use cookies and similar technologies to operate the Site, measure traffic and enable certain interactive features. On your first visit to the Site, you will be presented with a cookie consent banner allowing you to accept, decline or customize your choices. Necessary cookies (those required for the Site to function) are always active. Analytics and Functional cookies are activated only with your consent, and can be withdrawn at any time by clicking “Manage Cookie Preferences” in the Site footer.

Global Privacy Control and Do Not Track
Our Site recognizes and honors the Global Privacy Control (GPC) signal. If your browser or a browser extension transmits a GPC signal, we will automatically treat it as a valid opt-out of the sale or sharing of your personal information under the California Consumer Privacy Act and other applicable US state privacy laws, and Analytics and Functional cookies will not be activated regardless of any consent banner interaction.
We do not currently respond to browser “Do Not Track” signals because there is no consensus among industry participants regarding how to interpret them. GPC is the mechanism we honor.
Your Privacy Rights Under US State Laws
Depending on the state in which you reside, you may have specific rights with respect to your personal information. AFI USA recognizes and honors the following rights, where they apply to you:
- Right to know / access. You may request confirmation of whether we process personal information about you, and a copy of the specific pieces we have collected.
- Right to correct. You may request that we correct inaccurate personal information.
- Right to delete. You may request that we delete personal information we have collected from you, subject to legal and legitimate business exceptions.
- Right to portability. You may request a copy of your personal information in a portable format.
- Right to opt out of sale or sharing. You may direct us not to sell or share your personal information. AFI USA does not sell personal information and does not share it for cross-context behavioral advertising, but this right remains available to you.
- Right to opt out of targeted advertising. You may direct us not to process your personal information for targeted advertising. AFI USA does not conduct targeted advertising.
- Right to non-discrimination. We will not deny you services, charge you a different price, or provide you a different level of service because you exercised a privacy right.
These rights are available in various forms to residents of California (under the CCPA and CPRA), Texas (under the TDPSA), Delaware (under the DPDPA), Virginia (under the VCDPA), Colorado (under the CPA), Connecticut (under the CTDPA), Utah (under the UCPA), and other states with similar legislation as it comes into effect.
9.1 How to exercise your rights
To exercise any of the rights described above, email us at j.harkrider@axialfansint.com. Please include enough information for us to verify your identity (such as the name, email address and company you submitted through the Site) and a clear description of the request. We will respond within the time period required by applicable law, typically within forty-five (45) days.
9.2 Authorized agents
You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your own identity directly with us.
9.3 Appeals
If we deny your request, you may appeal our decision by replying to our response with the word “Appeal” and any additional information you would like us to consider. We will re-evaluate the request and respond within the time period required by applicable law.
Business-to-Business Context
AFI USA operates a business-to-business enterprise and does not sell products or services directly to consumers. Personal information collected through the Site is typically provided by individuals acting in their professional capacity, on behalf of their employer or business. Certain provisions of state privacy laws contain exemptions or limitations that apply to information collected in a business-to-business context. Where such exemptions apply, we may rely on them, but we will always honor the core rights described in Section 9 upon verified request.
Children's Privacy
The Site is not directed to children under the age of sixteen (16). We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16 without appropriate parental consent, we will delete that information promptly. International Data Access
AFI USA stores personal information on servers located in the United States. Because AFI USA is a wholly-owned subsidiary of AFI Italy, authorized personnel of AFI Italy may access personal information from Italy for the internal purposes described in Section 4.1. When such access occurs, AFI Italy is bound by equivalent confidentiality and data protection obligations.
Third-Party Links
The Site may contain links to third-party websites or resources that are not operated or controlled by AFI USA. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party sites you visit.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the “Effective date” at the top of this page and, where appropriate, provide additional notice through the Site. We encourage you to review this Privacy Policy periodically.
